Smashing Pumpkins are taking former record label Virgin to court over ‘breach of contract’ reports AP News Agency.

The Pumpkins are disputing that Virgin Records can use their name and music for marketing campaigns as it threatens their “artistic integrity.”

Smashing Pumpkins were signed to the label until their split in 2000, and since reforming in 2005 are now signed to Warner Music Group division Reprise Records.

The band dispute Virgin’s use of their music in ‘Pepsi Stuff’, a campaign run in conjunction with the drinks giant and shopping website Amazon.

According to papers filed at Los Angeles Superior Court, the band claims the Pepsi Stuff deal threatens their “artistic integrity”.

They add that the group would never grant such authority to Virgin “or any other entity”.

The band claim their previous contract with Virgin gives them the right to sell digital downloads of their songs – but it does not extend to any promotional campaigns.

Smashing Pumpkins demand that Virgin Records pay the band the profits earned in the promotion, and request an injunction to stop the future use of the group’s name and music.
